1. knowingly murdered a peace officer or fireman in the line of duty 2. intentionally committed murder in the course of committing or attempting to commit kidnapping burglary robbery aggravated sexual assault arson obstruction or retaliation or terroristic threat 3. commits the murder for payment or the promise thereof or employs another to commit the murder for payment or the promise of payment 4. commits the murder while escaping or attempting to escape from prison 5. while incarcerated in a penal institution murders another who is employed in the operation of the penal institution 6. while incarcerated for murder murders another 7. murders more than one person simultaneously or under the same scheme or course of conduct 8. murders an individual under six years of age 9. murders a court judge.
In fact one could even commit a single murder and if it doesn't satisfy any of the above the case would be BY LAW ineligible for the death penalty. The most famous example of this is Yolanda Saldivar the woman who murdered tejano singer Selena.
Personally I would prefer life WITHOUT POSSIBILITY OF PAROLE in these cases not out of any humanitarian notions but rather with the knowledge that the people in these cells would see where they are and know that that is the rest of their life and it would never change. At some point death would be welcomed.
